                              in the cassation appeal
                              for infringement of the law
                              held before us, Mr Andres
                              Vidal y Roger appels
                              against the decision of
      criminal chamber of the High Court of Barcelona dealing
      with the case heard at the First Instance Court
      in San Beltran at the aforementioned city, against
      Mr Emilio Vives and Mr Juan Budo for artistic property fraud.
      
      
      Whereas the said Vidal had acquired
      the property rights in Spain and Portugal of an Opera
      by Leveq entitled “Las cien doncellas” from the publishing
      house Branus y Compania in Paris in compliance with the

      Barcelona Numero noventa y dos
                  
                              En la villa y Corte de Madrid
                              a doce de Febrero de mil
                              ochocientos setenta y siete,
                              en el recurso de casación
                              por infraccion de ley que
                              ante Nos pende, inter-
                              puesto por Don Andres
                              Vidal y Roger contra la
                              sentencia pronunciada
      por la Sala de lo criminal de la Audiencia de Bar-
      celona en causa seguida a virtud de querella del mis-
      mo en el Juzgado de primera instancia de San Beltran
      de dicha Ciudad, contra Don Emilio Vives y Don Juan
      Budo por defraudación de propiedad artística.
      
      Resultando que el espresado Vidal adquirió de
      la Casa editorial Branus y Compania de Paris, la
      propiedad para España y Portugal, de la ópera del
      maestro Leveq, “Las cien doncellas” habien-
      dose cumplido los requisitos del tratado sobre propie-
