(Nr. 1089.) Supreme Cabinet Order of 16th August, 1827, for the institution of an
agreement with the individual States of the German Confederation, for the purpose
of mutual protection of the rights of authors and publishers
against the reprinting of books.
Since at present the negotiations at the Federal Assembly in Frankfurt-on-the-Main, whose aim
it is to achieve, in compliance with Article 18 of the German Federal Act, uniform provisions for the
safeguarding of authors and publishers and reprinting, have not yet led to the desired result; I therefore
give My approval to the request, made in your joint report of the 23rd of last month, for the initiation of
negotiations with those German States in which the reprinting of books is forbidden, in order to come to
an agreement, though with the reservation of further measures in this matter that might be passed by a
mutual Federal Resolution, whereby in the application of the existing laws any distinction between natives
and foreigners with regard to these States' respective subjects is to be removed, and the latter are to receive
the same protection for their publications as natives. I also give My approval to these agreements, as soon as
they have been ratified by the exchange of ministerial declarations, being brought to the knowledge of the
public by means of the Code of Laws, so that on the strength of My present Order, which is also to be
incorporated into the Code of Laws, they shall acquire legal force.

(Nr. 1090) Ministerial Declaration of 11th September, 1827, on the agreement made with
Hanover, regarding the protection of the rights of authors and publishers
in both States against the reprinting of books.
The Royal Prussian Ministry for Foreign Affairs hereby declares, in
accordance with the authorization it has received from His Majesty:
since the Royal British and Hanoverian Government has given the
assurance, that for the time being and until, in accordance with
Art. 18 of the German Federal Act, a mutual Federal Resolution for
the protection of the rights of authors and publishers against the
reprinting of books has been passed, those legal provisions which
are currently in force in the Royal Hanoverian lands for the benefit
of native authors and publishers are to be also declared fully
valid for the protection of authors and publishers who are subjects
of the Prussian Crown and put into application,
that the prohibition against the reprinting of books, such as it is already in force
in the whole territory of the Prussian Kingdom, for the protection of native
authors and publishers, in accordance with the laws that are in place in its
various Provinces, is also to apply to the authors and publishers of the Kingdom
of Hanover, so that, consequently, every offence committed against the latter
by reprinting or the circulation of reprints is to be judged and punished according
to the same legal regulations, as if the injured parties happened to be authors or
publishers from the Prussian lands.
The present Declaration is, once it has been exchanged for an equivalent
Declaration, ratified by the Royal British and Hanoverian Cabinet of Ministers,
to come into force and effect by promulgation in these States on 1st November
of the current year 1827.

(Nr. 1091) Ministerial Declaration of 18th September, 1827, on the agreement
made with the Grand Duchy of Hessen, regarding the protection of
the rights of authors and publishers in both States against the
reprinting of books.
Since the Royal Prussian Government has, for the purpose of the better protection
of authors and publishers against the reprinting of books until the uniform measures
promised in Article 18 of the German Federal Act have been attained by means of
a mutual Federal Resolution, received the following assurance from the Grand Ducal
Hessian Government:
that the subjects of the Prussian Crown – authors and publishers – are,
with regard to the reprinting of books and protection against this, to be
treated exactly the same as, and no differently to, the Grand Duke's own
subjects, and that, therefore, the Grand Ducal Hessian law-courts are
bound to accord all Royal Prussian subjects who consider themselves to
have been injured by a reprinting offence committed against them in
the Grand Duchy of Hessen, the same protection in all respects, which
they are obliged to accord to the Grand Duke of Hessen's subjects; -
that, moreover, if Royal Prussian subjects, after thorough consideration
of their interests, consider that they will obtain a more complete and surer
protection against reprinting in the Duchy if they have a special privilege
of the kind to be granted in accordance with the Grand Ducal Ordinance
of 11th May, 1826, then, on the part of the Grand Duchy, the Royal Prussian
subject who applies for such a privilege is to have his situation considered
in an equally favourable light, just as if a subject of the Grand Duke of
Hessen had made this request for a privilege; lastly, that the former will
not have to pay any tax, but merely the stamp duty, which is what
a subject of the Grand Duchy would also have to pay; -
the undersigned Ministry for Foreign Affairs declares, in accordance with the
authorization it has received from His Majesty:
that the prohibition against the reprinting of books, such as it is already in force
in the whole territory of the Prussian Kingdom, for the protection of native
authors and publishers, in accordance with the laws that are in place in its
various Provinces, is also to apply to subjects of the Grand Duchy of Hessen,
and that, consequently, every reprinting offence committed against the latter
is to be judged and punished according to the same legal provisions, as if Royal
Prussian subjects had been the injured party.
The present Declaration is, once it has been exchanged for an equivalent
Declaration, ratified by the Grand Ducal Hessian Ministry for Foreign Affairs,
to come into force and effect by promulgation in these States.

with the authorization it has received from His Majesty:
since the assurance has been made by the Government of the Duchy of Oldenburg,
that, with reservation of any general measures for the safeguarding of the rights of authors
and publishers against the reprinting of books that may yet be forthcoming, in
compliance with Article 18 of the German Federal Act, for the time being those
legal prohibitions which the Duchy's Penal Code contains under Article 416, for
protection against reprinting, are to also apply in full measure and expressly
to the publications of authors and publishers who are subjects of the Prussian Crown.

(Nr. 1098) Prussian Ministerial Declaration on the agreement made with Schaumburg-Lippe,
regarding the protection of the rights of authors and publishers
against the reprinting of books. Date: 24th September, 1827.
The Royal Prussian Ministry for Foreign Affairs hereby declares, in accordance
with the authorization it has received from His Majesty:
since the assurance has been made by the Government of the Principality of
Schaumburg-Lippe, that for the time being and until, in accordance with Article 18
of the German Federal Act, a mutual Resolution has been reached for the
protection of the rights of authors and publishers against the reprinting of books,
it will grant to every Royal Prussian subject, author or publisher, upon a duly
submitted request, a privilege against reprinting under the same conditions as
for a native subject of the Principality, and without any taxation, and that the
privilege will always explicitly state the penalty for reprinting, which, apart
from confiscation of the reprinted copies, is also to consist of payment of the
legitimate retail price of 500 to 1,000 copies, and, in the case of trading with such
privileged books that have been reprinted elsewhere, of confiscation of all
the reprint copies that are discovered.

The Royal Prussian Ministry for Foreign Affairs hereby declares, in accordance
with the authorization it has received from His Majesty:
since the Government of the Duchy of Braunschweig-Lüneburg has made the
assurance, that, with reservation of any general measures for the safeguarding
of the rights of authors and publishers against the reprinting of books that may
yet be forthcoming, in compliance with Article 18 of the German Federal Act,
for the time being an explicit provision will be brought into effect across the
Ducal Territory, whereby reprinting and the circulation of reprints are to be
punished with confiscation and a fine of 10 Reichsthaler, for the protection of
authors and publishers who are subjects of the Prussian Crown;
that the prohibition against the reprinting of books, such as it is already in force
in the whole territory of the Prussian Kingdom, for the protection of native
authors and publishers, in accordance with the laws that are in place in its
various Provinces, is also to apply to the writers and publishers of the Duchy
of Braunschweig, and that, consequently, every reprinting offence committed
against the latter is to be judged and punished according to the same legal
provisions, as if authors and publishers from the Prussian lands had been the
injured party.
The present Declaration is, once it has been exchanged for an equivalent
Declaration, ratified by the Ministry of State of the Duchy of Braunschweig-
Lüneburg, to come into force and effect by promulgation in these States.

Sondershausen, regarding the protection of the rights of
authors and publishers against the reprinting of books.
Date: 6th October, 1827.
The Royal Prussian Ministry for Foreign Affairs hereby declares, in accordance
with the authorization it has received from His Majesty:
since the Government of Schwarzburg-Sondershausen has made the
assurance, that in the Principality of Schwarzburg-Sondershausen, with
reservation of any further protection which, in compliance with
Article 18 of the German Federal Act, the rights of authors and
publishers against the reprinting of books can expect to receive in
future, through the uniform measures promised in the same article,
for the time being the special ordinance to be enacted, whereby the
reprinting of books and the circulation of reprints is explicitly
forbidden on pain of confiscation and a fine of 100 Reichsthaler,
and, what is more, regardless of whether it is native or foreign
authors and publishers who are the injured party, insofar as, with
regard to foreign territories, the subjects of the Principality of
Schwarzburg-Sondershausen enjoy the same advantages there,
is to apply to the benefit of authors and publishers in the Royal
Prussian lands.

(Nr. 1102) Ministerial Declaration of 19th October, 1827, on the agreement made with
the free Hanseatic city of Lübeck, regarding the protection
of the rights of authors and publishers against the reprinting
of books.
The Royal Prussian Ministry for Foreign Affairs hereby declares, in accordance
with the authorization it has received from His Majesty:
Since the Senate of the free Hanseatic city of Lübeck has promised, that
for the time being and until a mutual Federal Resolution for the protection
of the rights of authors and publishers against the reprinting of books
has been attained, in accordance with Article 18 of the German Federal
Act, every Prussian subject, be he an author or a publisher, who finds
himself in the situation of applying to the Senate for a privilege against
reprinting, will receive this in accordance with the same considerations
that would be observed if the applicant were a citizen or member of
Lübeck, at all times following the normal procedure and without any
fees except for small stamp and dispatching duties which citizens of
Lübeck are also liable to pay; and that, furthermore, the Royal Prussian
subject who is furnished with such a privilege will, as far as the
maintenance of the awarded privilege is concerned, be treated and
protected by the courts and authorities of Lübeck on the same footing
as a citizen or member of Lübeck who has been privileged against
reprinting.

Since the Government of the Principality of Schwarzburg-Rudolfstadt has promised,
that for the time being and until a mutual Federal Resolution for the safeguarding of
the rights of authors and publishers against the reprinting of books has been passed,
in accordance with Article 18 of the German Federal Act, an explicit provision
will be brought into effect in the Principality of Schwarzburg-Rudolfstadt,
whereby reprinting and the circulation of reprints is to be punishable by
confiscation and a fine of 10 Reichsthaler, for the protection of authors and
publishers from the Royal Prussian lands.

Since the Senate of the free and Hanseatic city of Bremen has made the assurance,
that, with reservation of any general measures that may be passed in future
for the safeguarding of the rights of authors and publishers, in accordance
with Article 18 of the German Federal Act, for the time being a prohibition
against reprinting and the circulation of reprints, to be specially enacted
for this purpose, covering the city of Bremen and its territory, is to apply
explicitly and in fully equal measure to the publications of authors and
publishers from the Kingdom of Prussia;
that the prohibition against the reprinting of books, such as it is already in force
in the whole territory of the Prussian Kingdom, for the protection of native
authors and publishers, in accordance with the laws that are in place in its
various Provinces, is also to apply to the writers and publishers of the free and
Hanseatic city of Bremen and its territory, and that, consequently, every reprinting
offence committed against the latter is to be judged and punished according to the
same legal provisions, as if authors and publishers from the Prussian lands
had been the injured party.

legal provisions currently in place in the Kingdom of Saxony against the
reprinting of books and the circulation of reprints are, with reservation
of the further protection that may be instituted in future for the rights of,
authors and publishers, in compliance with Article 18 of the German
Federal Act, through the uniform measures promised there, to apply in
exactly the same extent for the protection of authors and publishers from
the Royal Prussian lands, just as if Royal Saxonian subjects happened to be
the injured party, and without any special privileges against reprinting
being required for this purpose.

The Royal Prussian Ministry for Foreign Affairs hereby declares, in accordance
with the authorization it has received from His Majesty:
Since the Government of the Duchy of Nassau has made the assurance,
that the existing legal provisions in the Duchy against the reprinting of
books and the circulation of reprints are, with reservation of any further
protection which may yet be enacted, in compliance with Article 18
of the German Federal Act, though the uniform measures promised
there, are to apply in exactly the same extent for the protection of
authors and publishers from the Royal Prussian lands, just as if
subjects of the Duchy of Nassau were the affected party, and that,
in particular, in those cases where it is still a matter of special
privileges, or where such privileges are normally granted to subjects
of the Duchy, every Prussian subject who applies for such a
privilege will have his situation considered in exactly the same
light as would be the case for the privilege application of a native,
and that no stamp duties, taxes, or other fees are to be charged
for such a privilege,
that the prohibition against the reprinting of books, such as it is already in force
in the whole territory of the Prussian Kingdom, for the protection of native
authors and publishers, in accordance with the laws that are in place in its
various Provinces, is also to apply to the writers and publishers of the Duchy
of Nassau, and that, consequently, every reprinting offence committed against
the latter is to be judged and punished according to the same legal provisions, as

agreement with the individual States of the German Confederation, for the purpose
of mutual protection of the rights of authors and publishers
against the reprinting of books.
Since at present the negotiations at the Federal Assembly in Frankfurt-on-the-Main, whose aim
it is to achieve, in compliance with Article 18 of the German Federal Act, uniform provisions for the
safeguarding of authors and publishers and reprinting, have not yet led to the desired result; I therefore
give My approval to the request, made in your joint report of the 23rd of last month, for the initiation of
negotiations with those German States in which the reprinting of books is forbidden, in order to come to
an agreement, though with the reservation of further measures in this matter that might be passed by a
mutual Federal Resolution, whereby in the application of the existing laws any distinction between natives
and foreigners with regard to these States' respective subjects is to be removed, and the latter are to receive
the same protection for their publications as natives. I also give My approval to these agreements, as soon as
they have been ratified by the exchange of ministerial declarations, being brought to the knowledge of the
public by means of the Code of Laws, so that on the strength of My present Order, which is also to be
incorporated into the Code of Laws, they shall acquire legal force.

Hanover, regarding the protection of the rights of authors and publishers
in both States against the reprinting of books.
The Royal Prussian Ministry for Foreign Affairs hereby declares, in
accordance with the authorization it has received from His Majesty:
since the Royal British and Hanoverian Government has given the
assurance, that for the time being and until, in accordance with
Art. 18 of the German Federal Act, a mutual Federal Resolution for
the protection of the rights of authors and publishers against the
reprinting of books has been passed, those legal provisions which
are currently in force in the Royal Hanoverian lands for the benefit
of native authors and publishers are to be also declared fully
valid for the protection of authors and publishers who are subjects
of the Prussian Crown and put into application,
that the prohibition against the reprinting of books, such as it is already in force
in the whole territory of the Prussian Kingdom, for the protection of native
authors and publishers, in accordance with the laws that are in place in its
various Provinces, is also to apply to the authors and publishers of the Kingdom
of Hanover, so that, consequently, every offence committed against the latter
by reprinting or the circulation of reprints is to be judged and punished according
to the same legal regulations, as if the injured parties happened to be authors or
publishers from the Prussian lands.
The present Declaration is, once it has been exchanged for an equivalent
Declaration, ratified by the Royal British and Hanoverian Cabinet of Ministers,
to come into force and effect by promulgation in these States on 1st November
of the current year 1827.

made with the Grand Duchy of Hessen, regarding the protection of
the rights of authors and publishers in both States against the
reprinting of books.
Since the Royal Prussian Government has, for the purpose of the better protection
of authors and publishers against the reprinting of books until the uniform measures
promised in Article 18 of the German Federal Act have been attained by means of
a mutual Federal Resolution, received the following assurance from the Grand Ducal
Hessian Government:
that the subjects of the Prussian Crown – authors and publishers – are,
with regard to the reprinting of books and protection against this, to be
treated exactly the same as, and no differently to, the Grand Duke's own
subjects, and that, therefore, the Grand Ducal Hessian law-courts are
bound to accord all Royal Prussian subjects who consider themselves to
have been injured by a reprinting offence committed against them in
the Grand Duchy of Hessen, the same protection in all respects, which
they are obliged to accord to the Grand Duke of Hessen's subjects; -
that, moreover, if Royal Prussian subjects, after thorough consideration
of their interests, consider that they will obtain a more complete and surer
protection against reprinting in the Duchy if they have a special privilege
of the kind to be granted in accordance with the Grand Ducal Ordinance
of 11th May, 1826, then, on the part of the Grand Duchy, the Royal Prussian
subject who applies for such a privilege is to have his situation considered
in an equally favourable light, just as if a subject of the Grand Duke of
Hessen had made this request for a privilege; lastly, that the former will
not have to pay any tax, but merely the stamp duty, which is what
a subject of the Grand Duchy would also have to pay; -
the undersigned Ministry for Foreign Affairs declares, in accordance with the
authorization it has received from His Majesty:
that the prohibition against the reprinting of books, such as it is already in force
in the whole territory of the Prussian Kingdom, for the protection of native
authors and publishers, in accordance with the laws that are in place in its
various Provinces, is also to apply to subjects of the Grand Duchy of Hessen,
and that, consequently, every reprinting offence committed against the latter

The Royal Prussian Ministry for Foreign Affairs hereby declares, in accordance

Schaumburg-Lippe, that for the time being and until, in accordance with Article 18

it will grant to every Royal Prussian subject, author or publisher, upon a duly
submitted request, a privilege against reprinting under the same conditions as

privilege will always explicitly state the penalty for reprinting, which, apart
from confiscation of the reprinted copies, is also to consist of payment of the
legitimate retail price of 500 to 1,000 copies, and, in the case of trading with such

the reprint copies that are discovered.

The Royal Prussian Ministry for Foreign Affairs hereby declares, in accordance
with the authorization it has received from His Majesty:
Since the Senate of the free Hanseatic city of Lübeck has promised, that
for the time being and until a mutual Federal Resolution for the protection
of the rights of authors and publishers against the reprinting of books
has been attained, in accordance with Article 18 of the German Federal
Act, every Prussian subject, be he an author or a publisher, who finds
himself in the situation of applying to the Senate for a privilege against
reprinting, will receive this in accordance with the same considerations
that would be observed if the applicant were a citizen or member of
Lübeck, at all times following the normal procedure and without any
fees except for small stamp and dispatching duties which citizens of
Lübeck are also liable to pay; and that, furthermore, the Royal Prussian
subject who is furnished with such a privilege will, as far as the
maintenance of the awarded privilege is concerned, be treated and
protected by the courts and authorities of Lübeck on the same footing
as a citizen or member of Lübeck who has been privileged against

will be brought into effect in the Principality of Schwarzburg-Rudolfstadt,

that the existing legal provisions in the Duchy against the reprinting of
books and the circulation of reprints are, with reservation of any further

there, are to apply in exactly the same extent for the protection of
authors and publishers from the Royal Prussian lands, just as if
subjects of the Duchy of Nassau were the affected party, and that,

of the Duchy, every Prussian subject who applies for such a
privilege will have his situation considered in exactly the same

in the whole territory of the Prussian Kingdom, for the protection of native
