Abstract:
In 1851, after the military insurrection of 1st May 1851, the Garret Bill returned to Parliament and was finally published on 18th July 1851. The Preamble of the 1851 Copyright Law claims «to protect the arts, the sciences and the letters, to pay tribute to the intellectual strength and power of the spirit that a representative government must recognise and honour, to guarantee freedom of thought and to strengthen even more so the freedom of expression» and «considers that the Bill presented to Parliament by MP João Baptista de Almeida Garrett (...) is based on the principles of justice and good reason, and in them are found rules already adopted and tried by the most cultured nations of the civilized world.» The 1851 Copyright Law includes provisions relating to rights of authors, to dramatic works, to artistic works and to musical works, as well as provisions relating to registration, criminal sanctions and national treatment to be granted to foreign authors regarding infringements of their rights in Portuguese territory, establishing in addition a period of protection of life plus thirty years.
