Swedish Ordinance on the Limitation of Terms of Protection, Stockholm (1841)

that the publication cannot be prosecuted according to the letter of the law, the matter shall be decided by the King's Grace as to whether publishers or printers, in such cases, may receive compensation from public funds for the expenses incurred for printing and paper that could have been withdrawn from the circulation.

 

14. Should the unforeseen event occur that the Committee on Freedom of the Press, pursuant to § 108 of the Instrument of Government, is brought to trial, the case shall be handled and decided by the Supreme Court of Sweden. Upon pronouncement of the judgment, all relevant records and documents, at public expense, shall be published to inform the public. If the matter is brought before the King's Supreme Court, the same procedure shall be followed. In such cases, the individual appointed by the Estates of the Realm to act as Deputy for the Office of the Chancellor of Justice shall be obliged to fulfil the duties of his office, arrange for the publication of legal proceedings, and oversee the proceedings before the Supreme Court.

 

15. All cases concerning offenses against this Law shall be handled expeditiously, and those involving questions of different punishments for various crimes shall be treated separately. The offender, in all cases where they have not already incurred the penalty of death or life imprisonment, shall be subject to the specific punishment prescribed by this Law for their offense.

Fines according to this law may not be converted into any other punishment than imprisonment or confinement, calculated at sixteen Riksdaler and thirty-two Skillingar per month of imprisonment, with each month counted as twenty-eight days. Fines below the mentioned amount correspond to a fourteen-day imprisonment in the locality where the offense occurred.

 

16. Fines under this law shall be divided equally between the prosecutor and the nearest institution for the poor, except in cases where fines, as mentioned above, solely belong to the plaintiff.

 



    


och forhållanden, att Skriften, efter Lagens bokstaf, ej åtalas kan, då ankommer det på Konungens Nådiga pröfning, om Forläggare eller Boktryckare må, i thy fall, till mer eller mindre del af Statsmedlen njuta någon ersättning för omkostnaden till tryckning och papper af hwad utaf upplagan kunnat indragas.

 

14:o Skulle den oformodade händelsen inträffa, att Tryckfrihets-Kommitteen, med anledning af 108 § Regerings-Formen, warder till answar ställd, upptages och afgöres målet af Swea Hof-Rätt, uppå åkären af Advokat Fiskalen derstädes Domen warder genast efter afkunnandet, med alla dertill hörande Protokoll och Handlingar, på publik bekostnad, genom trycket, befordrad till Allmänhetens kunskap. Kommer saken till Konungens Högsta Domstol, förhålles på enahanda sätt. Den man, som af Riksens Ständer blifwit tillförordnad att Justitie-Ombudsmannen i Embetet efterträda, ware wid sådant tilfälle pligtig, att hans Embetes skyldigheter utöfwa, föranstalta om tryckningen af rättegångshandlingarne samt biwista öfwerläggningarne uti målet hos Högsta Domstolen.

 

15:o alla mål, angående förbrytelser emot denna Lag, skola, wid answar for Domare och Embetsmän, med största skyndsamhet afgöras, och wid alla tilfällen, då fråga kunde uppstå om flera olika brotts bestraffning, särskilt behandlas, äfwensom den brottslige, i alla de fall, då han ej redan gjort sig saker till dödsstraff eller fästning för lifstiden, skall särskilt undergå den bestraffning, som han, enligt denna Lag, sig ådragit.

Böter efter denna Lag må ej förwandlas i annat straff än fängelse å fästning, efter beräkning af Sexton Riksdaler Tretiotwå Skillingar, såsom swarande emot hwarje månads fängelse, månaden räknad till Tjuguåtta dagar. Böter under ofwannämnde summa sware emot Fjorton dagars fängelse i orten, der förbrytelsen skett.

 

16:o Böter efter denna Lag gånge till twälskiftes emellan Åklagaren och närmaste inrättning för de fattige, de fall undantagna, då Böter, enligt hwad här ofwan är, målsäganden ensamt tillfalla.
