      fragments appear to be the same, it is observed
      that others are different in rhythm, harmony,
      tempos, movements, tone, beat, accompaniment and bass;
      
      Whereas in the previous expert
      evidence accepted by the decision, it cannot be said
      legally and rationally, that the accused reproduced
      someone else’s work in the sense of the prohibition
      stated in the said article ten of the Literary Property Act;
      
       Whereas, as a result, there is no
      violation of article five hundred and fifty-two of the Penal Code,
      and it cannot be applied to this case since no literary or industrial
      property fraud has been committed;
      
      
       We declare and we should declare that there is
      no case for the cassation appeal lodged by Mr Andrés Vidal y Roger;
      We order him to pay the legal costs and to lose his deposit of
      of one thousand pesetas, to which the action stipulated in the Law
      shall be applied; and the Court shall issue the corresponding
      certificate;
      
      


    


      al parecer se nota igualdad en algunos y contados
      fragmentos, se observa en los demás diferencias en
      el ritmo, armonía, tiempos, movimientos, tono compas,
      acompañamiento y bajo;
      
      Considerando que dada la anterior aprecia-
      cion pericial aceptada por la sentencia, no pue-
      de legal y racionalmente sostenerse, que los pro-
      cesados hayan reproducido una obra agena en el
      sentido de la prohibición contenida en el mencio-
      nado artículo diez de la ley de propiedad li-
      teraria;
      
      Considerando por tanto que no han incurrido
      en las penas señaladas en el artículo quinientos cin-
      cuenta y dos, del Código penal el cual carece de apli-
      cacion al hecho de autos, por no haberse cometido
      defraudacion alguna de propiedad literaria ó in-
      dustrial;
      
      Fallamos que debemos declarar y declaramos
       no haber lugar al recurso de casación interpuesto
      por Don Andrés Vidal y Roger; al que condenamos
      en las costas, y á la pérdida del depósito de mil pe-
      setas, al que se dará la aplicación prevenida en la
      ley; y libren á la Audiencia la certificacion
      correspondiente;
