      on 31 October 1876, having taken into account
      the stipulations of the Literary Property
      Act of 10 June 1847 and the convention
      with France regarding this matter of
      15 November 1853, and considering that
      the said rigadoons should not be deemed to be
      a reproduction of the said opera by means of a
      copy, extract or compendium of it,
      but as a piece of a special nature with its
      own structure and development,
      Mr. Emilio Vives and Mr. Juan Budó were acquitted
      and the Court would bear the legal costs;
      
      
      Whereas a cassation appeal for violation
      of law has been lodged against the said decision in the name
      of the private accuser, on the basis of article seven
      hundred and ninety-eight of the criminal procedural law,
      and mentioning the violation of article five hundred
      and fifty-two of the Penal Code; and the law of 10 June 1847,
      particularly its article eleven and



    


      uno de Octubre de mil ochocientos setenta y seis, tenien-
      do en cuenta los preceptos de la Ley sobre propiedad
      literaria de diez de Junio de mil ochocientos cuarenta y
      siete, y el tratado en Francia relativo a esta materia
      de quince de Noviembre de mil ochocientos cincuenta
      y tres, y estimando que los citados rigodones no debian
      considerarse como una reproducción de la espresada
      ópera por medio de copia, estracto ó compendio de
      ella, sino como una pieza de caracter especial con es-
      tructura y desenvolvimiento propios, absolvió libre-
      mente á Don Emilio Vives y Don Juan Budó y
      declaró de oficio las costas;
      
      Resultando que contra la mencionada sentencia
      se ha interpuesto en nombre del acusador privado, re-
      curso de casación por infraccion de ley, fundado en el
      artículo setecientos noventa y ocho sin espresar el caso
      de la de Enjuiciamiento criminal, y citando como in-
      fringidos el artículo quinientas cincuenta y dos del Có-
      digo Penal; y la ley de diez de Junio de mil ochocien-
      tos cuarenta y siete, especialmente su artículo once y
